Acceptance of Terms

These Terms of Service ("Terms") govern your use of the restaurant analytics services provided by infomatrixe AS ("infomatrixe", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.

These Terms apply to all users of our services, including restaurant owners, managers, staff members, and any other individuals who access our platform on behalf of a restaurant or food service establishment.

Description of Services

infomatrixe provides restaurant analytics dashboards and related services designed to help restaurant operators analyse sales performance, customer behaviour, menu effectiveness, inventory management, and other operational metrics. Our services include data collection, processing, analysis, and presentation through web-based dashboards and reports.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of our services without notice or liability.

User Obligations

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information when creating your account and using our services.

You agree not to use our services for any unlawful purposes or in any way that could damage, disable, overburden, or impair our systems. You must not attempt to gain unauthorised access to our services, systems, or networks, or interfere with other users' use of our services.

You are responsible for ensuring that any data you provide to us is accurate and that you have the necessary rights and permissions to share such data with infomatrixe for processing and analysis.

Intellectual Property

All content, software, and materials provided through our services, including but not limited to text, graphics, logos, images, software code, and data analysis tools, are the property of infomatrixe or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use our services solely for your restaurant operations. This licence does not include the right to reproduce, distribute, modify, or create derivative works based on our services or content.

You retain ownership of any data you provide to us, but you grant infomatrixe a licence to use, process, and analyse such data to provide our services and improve our platform.

Data and Privacy

Our collection, use, and protection of your personal data and business information is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to our data practices as described in the Privacy Policy.

We implement appropriate security measures to protect your data, but you acknowledge that no system is completely secure. You are responsible for implementing appropriate security measures on your end to protect access to your account and data.

Payment and Billing

Our services are provided on a subscription basis with fees as specified in your service agreement. Payment terms, billing cycles, and pricing are outlined in your specific service contract with infomatrixe.

All fees are non-refundable unless specifically stated otherwise in your service agreement. We reserve the right to modify our pricing with appropriate notice as specified in your service contract.

Limitation of Liability

To the maximum extent permitted by law, infomatrixe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or relating to your use of our services.

Our total liability to you for any claims arising out of or relating to these Terms or our services shall not exceed the amount you paid to infomatrixe in the twelve months preceding the claim.

We do not warrant that our services will be uninterrupted, error-free, or completely secure. Our services are provided "as is" and "as available" without warranties of any kind, either express or implied.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Denmark.

If you are a consumer resident in the European Union, you may also have rights under the laws of your country of residence, and nothing in these Terms affects those rights.

Termination

Either party may terminate the service agreement in accordance with the terms specified in your service contract. Upon termination, your access to our services will cease, and we may delete your account and associated data after a reasonable period, subject to our data retention policies and legal obligations.

We reserve the right to suspend or terminate your account immediately if you violate these Terms or engage in any conduct that we determine, in our sole discretion, to be harmful to our services or other users.

Termination of your account does not relieve you of any obligations to pay outstanding fees or charges incurred prior to termination.

Changes to Terms

We may modify these Terms from time to time by posting updated Terms on our website. We will provide notice of material changes through our services or by email. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.
